1. Agreement to Terms

By accessing and using TestReviewer.ai ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Service Description

TestReviewer.ai is an AI-powered technical assessment platform that helps recruiters and hiring teams evaluate candidates' technical skills through automated code review and analysis.

The Service includes:

  • AI-powered code review and scoring
  • Technical test creation and management
  • Candidate assessment portal
  • Dashboard and reporting features
  • Email notifications

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to:

  • Provide accurate and up-to-date registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use
  • Be responsible for all activities under your account

4. Payment and Billing

4.1 Pay-As-You-Go Pricing

We operate on a pay-as-you-go pricing model. You are charged per assessment based on your total usage volume, with automatic volume discounts applied. Pricing tiers are as follows:

  • 1–10 assessments: $15 per assessment
  • 11–50 assessments: $12 per assessment
  • 51–200 assessments: $8 per assessment
  • 200+ assessments: $6 per assessment

Volume discounts apply automatically based on your total assessment count. There are no monthly subscriptions, commitments, or hidden fees. You only pay for assessments you actually use.

4.2 Free Trial

New users receive a free trial with a limited number of assessments included. A valid payment method is required to start your trial. You will not be charged during the trial period. After the trial ends, you will be charged on a pay-as-you-go basis for any assessments you use.

You can use the service without any commitment and stop using it at any time without cancellation fees.

4.3 Payment Terms

All fees are in USD and charged based on actual usage. You receive your first 5 reviews for free. After that, you are charged per completed review according to our usage-based pricing tiers. You authorize us to charge your payment method for all fees incurred. Charges are typically processed at the end of each billing period (monthly) for accumulated usage, or immediately for one-time purchases.

You are responsible for maintaining a valid payment method on file. If payment fails, your account may be suspended until payment is resolved.

4.4 Refunds

Our service operates on a usage-based billing model. You receive your first 5 reviews for free, and are only charged for additional reviews you actually use. Since you only pay for completed reviews that have been processed and delivered, refunds are generally not available for completed assessments.

No refunds for completed reviews: Once a review has been completed and delivered, the service has been consumed and cannot be refunded. This includes reviews that were successfully processed, even if you are not satisfied with the results.

Technical issues: If you experience technical issues that prevent an assessment from completing properly (e.g., system errors, processing failures, or data loss), please contact us at support@testreviewer.ai within 7 days of the issue. We will review your case and may provide a credit or re-process the assessment at no additional charge.

Cancellation: You may stop using the Service at any time without cancellation fees. You will only be charged for reviews you have already used. No future charges will occur after you stop using the service.

Billing disputes: If you believe you have been charged incorrectly, please contact us at sales@testreviewer.ai within 30 days of the charge. We will investigate and resolve any billing errors promptly.

5. Acceptable Use

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to the Service
  • Reverse engineer or decompile the Service
  • Use the Service to harass, abuse, or harm others
  • Resell or redistribute the Service without authorization
  • Use automated means to access the Service (scraping, bots, etc.)

6. Intellectual Property

6.1 Our IP

The Service, including all software, algorithms, content, and trademarks, is owned by TestReviewer.ai and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service.

6.2 Your Content

You retain ownership of all content you upload (test instructions, candidate submissions, etc.). You grant us a license to process, analyze, and store this content solely to provide the Service.

6.3 AI-Generated Content

Analysis reports and scores generated by our AI are provided as-is for your use. We make no guarantees about their accuracy and recommend using them as one factor in your hiring decisions.

7. Data and Privacy

We collect and process data as described in our Privacy Policy. By using the Service, you consent to such collection and processing. We are committed to GDPR compliance for all users.

7.1 Data Protection

  • We use industry-standard security measures to protect your data
  • Candidate submissions are processed for assessment purposes only
  • We do not sell or share your data with third parties for marketing purposes
  • Data is processed by trusted sub-processors: Supabase (database), third-party AI processing services (AI analysis), Resend (email)

7.2 Data Retention

  • Active accounts: Data retained as long as your account is active
  • After cancellation: Account data retained for 30 days to allow reactivation, then permanently deleted
  • Legal records: Invoices and payment records retained for 10 years as required by French law
  • Backups: Technical backups retained for a maximum of 90 days
  • Device identifiers (anti-cheating): Non-suspicious identifiers deleted after 30 days; suspicious identifiers retained indefinitely to maintain platform integrity

7.3 Anti-Cheating and Integrity Measures

To maintain the integrity of our assessment platform and prevent fraudulent activity, we employ device fingerprinting technology. This helps us detect and prevent cheating, including attempts by recruiters to take their own tests or other forms of assessment manipulation.

What we collect:

  • Anonymous device identifiers generated from browser and device characteristics
  • These identifiers cannot be used to personally identify you outside of our platform
  • No personally identifiable information is collected as part of this process

How we use this data:

  • To detect suspicious patterns that may indicate cheating or fraud
  • To flag assessments that may have been compromised
  • To maintain the integrity and fairness of our assessment platform

Data retention (GDPR-compliant):

  • Non-suspicious identifiers: Automatically deleted after 30 days
  • Suspicious identifiers: Retained indefinitely (or up to 5 years) to enforce platform integrity and prevent repeat violations
  • This retention policy ensures we can maintain platform security while respecting your privacy rights

You have the right to request information about any device identifiers associated with your account and to request their deletion, subject to our legitimate interest in maintaining platform integrity for flagged suspicious activity.

7.4 Your GDPR Rights

Under GDPR, you have the right to:

  • Access: Request a copy of your personal data
  • Rectification: Correct inaccurate or incomplete data
  • Erasure: Request deletion of your data ("right to be forgotten")
  • Portability: Receive your data in a machine-readable format
  • Objection: Object to processing of your data
  • Restriction: Request restriction of data processing

8. Service Availability and Support

We strive to maintain high availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the Service at any time.

Support is provided via email (support@testreviewer.ai). All users receive standard email support. Priority support may be available for high-volume users (200+ assessments).

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY FRENCH LAW, TESTREVIEWER.AI (operated by 7om Tech) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims arising from or related to the Service shall not exceed the total amount you paid to us in the 12 months immediately preceding the claim.

Nothing in these Terms shall limit or exclude our liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded or limited under French law

10. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be error-free or uninterrupted
  • AI assessments will be 100% accurate
  • The Service will meet your specific requirements
  • Any errors will be corrected

11. Termination

11.1 By You

You may stop using the Service at any time. Simply discontinue creating new assessments. You will only be charged for assessments you have already used. There are no cancellation fees or commitments.

You may also request account deletion from your account dashboard or by contacting us. Upon account deletion, all your data will be permanently deleted in accordance with our data retention policies.

11.2 By Us

We may suspend or terminate your account under the following circumstances:

  • Non-payment: 14 days notice if payment fails, then account suspension
  • Terms violation: Immediate suspension for serious violations (fraud, abuse, illegal activity)
  • Other violations: 7 days notice for other breaches with opportunity to remedy

11.3 Effect of Termination

Upon termination:

  • Your access to the Service will be immediately revoked
  • You will no longer be charged for future reviews
  • You will only be charged for reviews that were completed before termination
  • Your data will be retained for 30 days to allow account reactivation
  • After 30 days, all data will be permanently deleted (except invoices retained for legal compliance)
  • You may request immediate data deletion by contacting us

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of France, without regard to conflict of law principles.

Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the competent courts of France.

In accordance with European Commission Regulation, you also have the right to submit complaints to the European Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

14. General Provisions

Entire Agreement: These Terms constitute the entire agreement between you and TestReviewer.ai.

Severability: If any provision is found unenforceable, the remaining provisions continue in effect.

No Waiver: Our failure to enforce any right does not constitute a waiver.

Assignment: You may not assign these Terms without our consent. We may assign them freely.
